Rationale & Analysis

Prosecutorial Discretion Act is a fairly straightforward proposal which mandates little more than a minimum floor of acceptable legal practice, so as to prevent biased or discriminatory outcomes and proceedings. In this, its primary mandates are with regards to mandatory recusual, - wherein a prosecutor is not permitted to act in any cases wherein they have a conflict of interest, - measures to prevent retaliation against defendants, and review of legal processes generally. While these are not entirely sufficient measures, they are not bad ones.

To note; while it is not sufficient to dissuade the Ministry of World Assembly Affairs from issuing this recommendation, we are displeased with the flattening of the varied legal systems of Member-States by mandating a private right of civil action in Clause 1.c. This is not a requirement that cannot be abrogated by more efficient or less exploitative legal systems than those focused primarily at making lawyers money, but it is not something we should have to work around. We would hope that the author is more considerate of the differences in legal systems between Member-States in the future.

As such, the Ministry of World Assembly Affairs has directed Kethania to vote FOR Prosecutorial Discretion Act, and urges the Bloc's World Assembly nations to do the same.
